Multuculturalism in mexican constitutional Law: A comparative survey of federal and subnational constitutions

The complexity of the contemporary State and the constant migratory phenomena make multiculturalism represent a material presupposition of the political community, which integrates the human component within the Constitutional State; At the same time, the federal State constitutes an institutional guarantee for the integration of cultural plurality as a constitutional value and as a principle of human right. For this reason, at present its development cannot be limited to the recognition in the Federal Constitution of multiculturalism, but also requires harmonization with the specificities that local constitutionalism offers in this regard, according to the social, political and ethnic pluralism that each state entity presents. The purpose of this article is to show the approach that multiculturalism has taken in the Mexican constitutions, both federal and local, based on a classification of the constitutional guarantees that it entails.
